Buying Property in Georgia as a Foreigner: Rules, Taxes, Registration and Residence
A practical 2026 guide for foreign buyers in Georgia: what you may own, how to check title, register a sale, budget for fees, understand taxes and assess property-based residence routes.

Foreigners can generally buy apartments in Georgia without first obtaining a residence permit. Yet paying the seller or signing an agreement is not enough: ownership acquired through a transaction must be registered in the Public Registry. Agricultural land is subject to a different, restricted regime. These distinctions matter before any deposit changes hands. Civil Code and law on the legal status of aliens
The more useful question is not how fast the paperwork can be completed but how sound the deal is. A verified seller, a clean title, transparent payment terms and a registered ownership extract matter more than a promise to “complete everything in an hour”. Off-plan properties add questions of delivery, designated use and legal safeguards.
What can a foreign buyer own?
Asset | General position for a foreign buyer | Check before paying |
Ordinary apartment | Generally permissible to purchase | Registry title and designation |
Urban commercial unit | Permissible subject to asset rules | Legal use and registration |
Agricultural land | Restricted regime with defined exceptions | Registered category and eligibility |
Georgian law generally allows foreigners to own, inherit and transfer property, subject to statutory restrictions. There is no general rule requiring Georgian citizenship or a residence permit before buying an ordinary apartment or urban commercial unit. What matters is the legal classification of the exact asset—not the name used in the listing. Law on the Legal Status of Aliens, Article 32
Agricultural land is the important exception. The Organic Law provides a restricted ownership regime and specific exceptions, including inheritance and certain statutorily approved investment structures. Incorporating a Georgian company with foreign control is not, by itself, a way around the restriction. If a house comes with land, inspect the registered land category before signing. Organic Law on Agricultural Land Ownership
An ordinary apartment, hotel-style unit, right in an unfinished structure and plot of land are not interchangeable assets. Establish exactly what is for sale, whether the right can be registered in your name, and whether the intended use is legally permitted.
Four stages of the purchase

Start with the cadastral identifier and a current registry extract. Match the address, floor area, property classification, owner and registered burdens. For land, verify boundaries, designation and access. A brochure or screenshot is no substitute for official records. Public Registry fees and services
Next, agree the written sale contract. Identify the unit precisely and specify the price, payment currency and mechanism, consequences of delay, termination and refunds, delivery date, finishing standard and the obligations of both parties. With an off-plan development, check the permits, payment schedule and construction specification too.
Then submit the transaction for registration. Article 183 of the Civil Code requires a written transaction and registration of the purchaser’s title. Avoid a payment structure that leaves you unprotected if the Registry refuses registration. Civil Code of Georgia, Article 183
Finally, obtain the fresh extract in your name. Recheck the cadastral details, sign a handover report, record utility meters and establish management fees, utility contracts, building access and any restrictions on letting the property.
Documents worth checking before a deposit
At minimum, review the current ownership extract, cadastral details, the seller’s acquisition documents, mortgages, seizures or other restrictions, and the identity and signing authority of the seller. For a developer, request the land documents, construction permits, evidence of authority to sell the identified unit and a complete draft contract.
A tempting minimum price may describe an unusual legal or physical asset. A basement or technical-level unit can differ substantially from a standard residential apartment in permitted use, daylight and accessibility. Legal title does not automatically mean a unit is suitable for family living.
Read any management agreement as carefully as the sale contract. A serviced-apartment scheme may carry mandatory fees, restrictions on self-management, limited access to amenities and refurbishment obligations. Marketing estimates of rental profit are not contractual guarantees.
Registration fees and the total buying budget
Registration service | Turnaround | Published fee |
Ownership registration | 4 working days | 150 GEL |
Ownership registration | 1 working day | 270 GEL |
Ownership registration | Filing day | 350 GEL |
The National Agency of Public Registry currently lists a title registration fee of 150 GEL for four working days, 270 GEL for one working day or 350 GEL for filing-day service. Extracts are a separately priced service. Confirm the tariff that applies when you submit the documents. Official Public Registry registration fees
Allow for independent legal review, translations and certification where necessary, bank charges, valuation if required for a mortgage or residence application, contractual insurance and preparation for occupation. There is no honest one-size-fits-all amount for these ancillary costs.
The advertised price also says little about the ongoing cost of ownership. Ask about service charges, utility connections, parking, communal facilities, management contracts and the tax treatment of your intended use.
Can you buy while abroad?
A buyer outside Georgia should agree the signature, identification, representation and payment process with the registrar and bank in advance. If an authorised representative is used, verify the form and scope of the power of attorney, its acceptance and any translation or legalisation requirements. Do not assume every transaction can be completed remotely by proxy.
One especially important limitation: the Registry’s Smart Contract remote service is stated to be available to Georgian citizens with a valid Georgian identity card or passport. It is not a general online purchase channel for buyers who only hold a foreign passport. Confirm the eligibility of every participant before relying on it. Official Smart Contract FAQ
Check beneficiary banking details against the contract, be prepared to explain the source of funds and document what happens if the registration does not complete. Where a protected payment service is used, rely on its written conditions rather than a broker’s generic assurances.
Taxes on holding, renting and selling
Buying a property and owning it trigger different tax questions. The Tax Code includes an exemption from individual property tax on taxable property other than land when family income in the preceding year does not exceed 40,000 GEL. Above applicable thresholds, property-tax bands and specific rules apply; land is assessed differently. A cross-border owner should verify their own filing position. Tax Code of Georgia, Articles 201–206
For an individual letting residential space for residential use and claiming no deductions, Article 81 sets a 5% income-tax rate. Tourist accommodation, hotel-style activity and certain management structures may be taxed differently. Do not automatically apply this figure to short stays. Tax Code of Georgia, Article 81
The Tax Code generally exempts surplus on the sale of a residential apartment held for more than two years, subject to the relevant conditions. A shorter holding period or a different type of transaction calls for an individual tax calculation. Foreign buyers should also examine any obligations in their tax-residence country. Tax Code of Georgia, Article 82
Does property ownership qualify you for residence?
Residence route | Market-value threshold | Important detail |
Short-term property-based | Above USD 150,000 | Certified valuation; approval required |
Investment property-based | Above USD 300,000 | Additional criteria and documentation |
Owning an apartment and obtaining immigration status are separate matters. The official short-term property-based residence route refers to registered ownership of non-agricultural real estate with a market value exceeding the GEL equivalent of USD 150,000. The value must be confirmed by an appropriately certified valuer; eligible spouses and children have associated procedures. State Services Development Agency: residence permits
The property route for an investment residence permit has a higher threshold: a market value exceeding the GEL equivalent of USD 300,000 plus additional application requirements. Maintaining the status is governed by further rules. Neither a developer’s price tag nor title registration guarantees that a permit will be approved. Official investment residence requirements
Consider an apartment with a USD 155,000 contract price. That number alone does not prove its qualifying market value exceeds the legal threshold. If residence is an important objective, obtain individual guidance on eligibility and valuation before signing.
Three practical buyer profiles
Buying to live: focus on residential designation, registered title, heating, building systems, traffic, schools, transport and monthly common-area charges. Your family’s day-to-day comfort matters more than the highest advertised investment return.
Buying to rent: verify that your intended letting model is permitted, understand operator contracts, expenses and seasonality. HomeRadar’s investment analysis helps test scenarios, but projected returns are not rental guarantees. How HomeRadar explains its analysis
Buying off-plan: examine permits, delivery stage, unit specification, change rights, payment protection and liability for delays. An attractive early price does not compensate for uncertainty about the right that can ultimately be registered.
The final checks before you transfer funds
Ask for the cadastral number, a current ownership extract, proof of the seller’s title and the project documents. Commission independent legal due diligence, read the contract in a language you understand and agree a defensible payment mechanism. Once title is registered, inspect the new extract and complete a proper handover.
Walk away or pause if you are pressed to pay an unrelated third party, offered guaranteed residence regardless of the asset, denied access to a current extract, or presented with a deposit clause that makes refunds impossible to understand. Make sure the property described in marketing is the property the contract actually transfers.

Frequently asked questions
Can a foreigner buy an apartment without a residence permit?
Generally, yes. The purchase itself does not require a prior residence permit, but ownership through a sale must be registered.
Can a foreigner buy a house with land?
Check the classification. Agricultural land ownership is restricted and exceptions are specific; consult cadastral records and legal advice.
Is paying and signing enough to become the owner?
No. The buyer’s ownership right under the transaction must be registered in the Public Registry.
How much is the state registration fee?
Official published rates are 150 GEL for four working days, 270 GEL for one working day and 350 GEL for filing-day registration.
Can foreign-passport holders use Smart Contract?
The Registry currently restricts this remote service to Georgian citizens with a valid Georgian ID or passport.
Does buying for USD 150,000 guarantee residence?
No. The short-term property route requires certified market value above the threshold, the proper documents and an approved application.
Is rental income always taxed at 5%?
No. The 5% rule relates to defined residential rental arrangements without deductions; short-stay hospitality may differ.
What matters most with an off-plan apartment?
Verify land title, permits, the actual contractual unit, delivery commitments, payment safeguards and registration options.
The safest purchase is not necessarily the fastest one. Confirm what you own, what it will cost to hold and when title actually moves into your name.
